Nicholas Toth, 43, was arrested and charged for causing the crash that resulted in the death of the other driver, Michael Maddock, just before 8:30 p.m. on Tuesday, July 16, the Warminster Township Police Department said.
Police papers obtained by Daily Voice show Toth had been going more than three times the posted speed limit of 25 miles per hour at the time of the crash at Newtown Road near Coventry Lane.
Toth told police that it was raining and dark at the time, and that impacted his visibility.
Toth said he saw another vehicle coming toward him and tried to make a left-hand turn onto Coventry Lane without yielding, which police say caused the crash that killed Maddock. Maddock was found slumped over the passenger's seat and had to be extricated from the vehicle by firefighters, police paperwork shows.
Toth was charged with Homicide by Vehicle, Reckless Driving, and Driving Vehicle at Safe Speed, according to police.
Maddock's obituary on the Wetzel and Son website shows he was born in Philadelphia and worked as an auditor for the U.S. government for more than 40 years.
The "king of dad jokes," Maddock enjoyed playing Santa, and was often mistaken as Santa Claus, his obituary continued. He loved spending time with his family and was known as "Poppy" to his 18 grandchildren. Aside from his wife, Betsy, who predeceased him, his grandkids were the loves of his life, his obituary said.
A GoFundMe for the family had raised more than $4,000 as of press time.
Toth's preliminary hearing is scheduled for Monday, Nov. 4, according to court documents. Unsecured bail was set at $100,000.
